Terms of Service

1. Acceptance of Terms
By placing an order or using services from omote.live ("we," "us," "our"), you ("Client," "you") agree to these Terms of Service. If you do not agree, please do not use our services.
2. Definitions
- OMOTE: The brand and services provided by omote.live, operated as a sole proprietorship by Dwi Aprilia.
- Service: Custom VTuber model illustration and Live2D rigging.
- Client: The individual or entity purchasing our Service.
- Order: A confirmed purchase of a Service.
- Brief: The creative specification submitted by the Client after payment confirmation.
3. Services Overview
We provide custom VTuber model design and Live2D rigging based on the Client's specifications. Services are categorized into Standard, Premium, Performance, and Ultra tiers, each with different timelines, revision allowances, and inclusions.
4. Order, Payment, and Confirmation
- Payment is required in full before production begins.
- We use Paddle as our Merchant of Record. All transactions are handled through Paddle's secure checkout.
- Once payment is confirmed, you will receive an email with a secure link to submit your project brief.
- Production does not start until the brief has been submitted and reviewed.
5. Brief Submission and Scope
- The brief is the foundation of your project. We recommend providing as much detail as possible (character traits, references, style preferences, etc.).
- Requests outside the scope of the approved brief may incur additional fees.
- OMOTE is not responsible for delays caused by incomplete or unclear briefs.
6. Production Timeline
- Estimated production time: 21 to 45 days depending on the package and our current queue.
- Production begins after your brief has been reviewed (typically within 2–3 business days).
- Timelines are estimates and may vary based on complexity. We will notify you of any significant changes.
7. Revisions Policy
Revisions are provided based on your selected package:
- Standard: 1 round of revision
- Premium: 3 rounds of revision
- Performance & Ultra: Unlimited revisions
Requests that significantly alter the original brief or exceed your package tier may incur extra fees.
8. Deliverables & Delivery
- Final files will be delivered via secure download link.
- Typical deliverables: PNG files, Live2D model files (.moc3, .model3.json), and expression data.
- Ultra Package: Includes source files (.PSD & .CMO3).
- You are responsible for backing up your files. We are not liable for loss or corruption after delivery.
9. Refund & Cancellation Policy
- Once production begins, refunds are generally not available.
- In exceptional cases, refunds or cancellations may be granted at our sole discretion.

Important: Chargebacks without prior communication are a breach of these Terms and may result in legal action.
10. Intellectual Property
Upon full payment and delivery, you receive a license to use your model for personal or commercial purposes (subject to commercial rights terms below).
OMOTE Retains:
- Proprietary rigging systems and workflows
- Template assets not specific to your creative brief
- The right to showcase your model in our portfolio and promotional materials
11. Commercial Rights
- All packages include 100% commercial rights.
- You may use your model for streaming, content creation, merchandising, or any revenue-generating activity.
- You may not resell, redistribute, or claim ownership of OMOTE's underlying systems or workflows.
12. Limitation of Liability
OMOTE is not liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or opportunities
- Issues caused by third-party software (e.g., VTube Studio, OBS)
- Delays beyond our reasonable control (force majeure, technical failures, etc.)
Our maximum liability is limited to the amount you paid for the Service in question.
13. Governing Law
These Terms are governed by the laws of Indonesia. Any disputes shall be resolved through good faith negotiation or, if necessary, through the courts of Indonesia.
